DMS Racing Trading Terms and Conditions (Published 17th March 2007 (Last amendment 21/2/2018)
DMS Racing has made every effort to ensure that the information on our web site and in our literature or adverts is accurate at the time of production. DMS Racing will not be held liable for any errors, omissions or price changes whatsoever. We reserve the right to change prices at anytime.
All products are subject to availability. All sizes, measures, colours and specifications are only given as a guide and are correct to the best of our knowledge.
In all cases we request to have a daytime contact telephone number for you. We will be unable to process any order without it. This is so we can contact you during the day if we have any issues with payment and for security checks. In the event that a particular product is out of stock at the time of ordering we reserve the right to substitute with an equivalent or higher spec direct replacement at our own discretion, in most cases we will inform you of this decision prior to despatch.
DMS Racing reserve the right to refuse business if the customer is to be believed to have behaved in such a manner as to damage the sport or trade of DMS Racing or R/C model car racing in general.
Security is probably one of the most significant concerns for both the shopper and the retailer during an online transaction.
We ensure that every online purchase you make from DMS Racing is a secure and trusted transaction with all our systems operating to strict PCI DSS compliance.
We take payments for your goods via Worldpay accepting most major credit cards, however you are still able to use your bank account for direct transfers, cash, cheque or postal orders if you prefer.

Our hours of business are displayed on the home page here on our website. We are closed on all Saturday's, Sunday's and Bank Holidays unless otherwise stated.
Orders and Shipping
Subject to stock availability and status of the items ordered, we will send all orders received before 3pm weekdays, that same day. Exceptions will be Bank Holidays and Weekends. Some items will be sent via the most appropriate method from our website, if a customer chooses a method that is unsuitable or incorrect for the goods that have been ordered we reserve the right to alter that method and send via the appropriate means. Please refer to our website for full details of shipping methods and costs at the checkout stages. Any back ordered items will be sent on to you as soon as they are received by us, at NO EXTRA postage cost to the customer, you only pay the postage on your initial order, which is the correct amount for the total value and size of your whole order. We will place all “out of stock” items on back order for an unlimited time period and supply at the first opportunity that they become available UNLESS we are specifically told otherwise by the customer at the point of sale. All back ordered items are charged at the price that is current when they arrive back into stock. ANY item that comes back into stock at a substantially higher price (over 20% more than has been advertised) will only be sent on to the customer provided that we have made either written or verbal contact first and have the full permission of the customer to do so. This policy ONLY applies to goods over the value of £10GBP. We also apply this policy to all items which move in price during stock exhaustion, all price REDUCTIONS are performed immediately, but price rises ONLY occur once stock has run out at the previous older lower price. Of course any item that is received under this value by the customer that is not required at the higher cost can be returned under the terms of our returns policy outlined below.
All advertised prices are in pounds Sterling and include VAT at the current rate

DMS Racing provides such links for your convenience only, and is not responsible for the content of any website linked to or from our Site. Links from our Site to any other website do not mean that DMS Racing approves of, endorses, or recommends that website. DMS Racing disclaims all warranties, expressed or implied, as to the accuracy, legality, reliability, or validity of any content on any other website.
We hope that you are pleased with your purchase from DMS Racing. However, we understand that there are occasions when you need to
return goods to us, in the event you need to cancel an order BEFORE it has been despatched we need written confirmation within 10 working days from the date of the order
Goods Faulty on Arrival
If your goods are faulty on arrival, you have 30 days to inform us of the fault. When the goods are returned to us and the fault has been verified, we’ll issue a replacement item if available or if preferred a full refund to you via your original payment method. For all electrical items we will send the product to the relevant distributor for evaluation first. This is to prove the fault is due to product failure rather than misuse or abuse. Please call for a returns number and follow the returns procedure outlined below.
Non Arrival of Goods
In the event that goods fail to arrive altogether you must notify us in writing within 28 days of original order (but not before 7 working days). We will then place a claim for loss with the appropriate carrier of your goods and issue a full duplicate order once the carrier has confirmed non-delivery (in some case this may take up to 15 working days before a claim can be lodged). We cannot be held responsible for lost time on non delivery of orders lost in transit and all orders will be either replaced or a credit note issued at our discretion.
Goods Damaged in Transit
If your goods were damaged in transit, we request that you report it to us within 3 days of receiving them. If goods are visibly damaged on receipt, its= is highly recommended to sign the delivery note accordingly. Once the damaged goods are received back into our premises, we will issue a replacement item if available with no additional cost for return or, a full refund to you via your original payment method if replacements are unavailable. Please call for a returns number and follow the returns procedure outlined below.
Goods Faulty in Warranty Period
If a product you have bought from DMS Racing develops a fault and it is within its warranty period, you are entitled to a warranty repair. Please call for a returns number and return the product to us in accordance with the above. We will then inspect the unit and where possible/allowed by the distributor exchange or replace the product with no additional cost to return. Some items such as electrical equipment, engines etc, will be sent to the relevant distributor for testing before any replacement or credit will be given. This is to check for abuse and misuse. Any item returned as faulty, for repair or exchange, that is found to have no faults, will incur a handling charge of 20% of the original retail value of the goods at our discretion.
Additional notes about warranty repairs
Please note that a replacement product will be provided only if repair is impossible (examples include: when the manufacturer/supplier is no longer trading; when spare parts are not available; or when repair is not practical). This decision is made at our discretion.
If you have simply changed your mind
If you have simply changed your mind about your order and you wish to return your goods, then in line with the Distance Selling Directive (DSD) you can do so provided you inform us of this decision and return your goods within 30 days from receipt. The goods must not be opened in any way nor used and must be 'as new' when returned to us. Once you've informed us of your decision to return goods, you have the remainder of the 30 days from date of purchase to do so at your own expense and ensure the goods are received back with us within that timescale. Once goods are received at DMS Racing, we'll issue either a credit note or a full refund for the cost of the goods to your original payment method, whichever is preferred by the customer, if neither is specified a credit note will be issued by ourselves. Any refund will be less any postage costs incurred by us. Please note this policy does have some limitations, such as special orders or specific goods such as magazines/literature, personalised goods and perishable goods. If the products have been opened, you will automatically be deducted 20% of the products current retail value from your refund amount.
Need to request a return?
Now you know our returns policy, you can request a return. To do this, simply call us on 01923 816636 and request a Returns number. It is essential you do this any item(s) sent back without a returns number may well be rejected or sent back to sender.
Following these steps will help ensure the products that you're returning to us arrive back correctly and in good condition. Failure to follow this procedure may result in your return being rejected upon receipt. Before returning any item(s) to DMS Racing please ensure you have performed the following:
- Have a valid Returns number issued by DMS Racing.
- Enclose all accessories supplied with a product unless informed specifically to do otherwise.
- Use all packaging that was originally supplied.
- Use a label for clear display of the Returns number (address below)
- Ensure our full address is clearly displayed on the outside of the package.
- Do NOT write directly on the box/packaging with pen/ink.
- Securely seal the packaging using a similar method as per the original delivery.
- Ensure your return is sent via some form of recorded delivery, as we will not be held liable for packages lost in transit or non-delivered.

Special Orders, Pre-Orders & Back Orders
Please note that any product that is ordered especially for you cannot be returned or cancelled, unless it is faulty. In which case please follow the procedures laid out above. Back orders will be sent to you as soon as we receive them from our suppliers, we cannot accept liability for long lead times due to non supply from our suppliers. Please ensure that any back ordered items not required any longer are cancelled in good time before any expected or arrival date that you may have been given. We cannot accept responsibility for cancellation of goods that have already been despatched. Any deposits placed for new pre-order items we regret are both non-refundable and non-transferable. Unlike many dealers we only ask for a smaller (approximatly 10%) deposit to secure any new item on its release date at our store. All deposits will be forfeited with any cancellation of an item prior to arrival.
DMS Racing's right to change these Terms and Conditions/Policy
We may add to, change, or remove any part of these Terms and Conditions of Use at any time, without notice. Any changes to these Terms and Conditions of Use or any terms displayed in our premises, made available by request or posted on our website apply as soon as they are posted. By continuing to use our website after any changes are posted, you are indicating your acceptance of those changes. DMS Racing may add, change, discontinue, remove, or suspend any other Content posted on this Site, including prices, features and specifications of products described or depicted on the Site, temporarily or permanently, at any time, without notice and without liability.
